These general conditions only govern our commercial relations with our customers for the sales and services presented on the Flaronis website and, more generally, apply to all commercial documents issued by our company.
Any order implies prior consultation and acceptance of these General Conditions, which are available and printable at any time through a direct and permanent link on this site.
It is understood that persons considered legally incapable of contracting within the meaning of the Civil Code, including minor children, must imperatively obtain the authorization of their legal representative before placing an order.

Ordered

You can order on our website by selecting the items of your choice, you then place them in your shopping cart by clicking on the "Add to cart" button.
In order to correct data entry errors, you can access the summary content of your basket at any time until the order has not been definitively confirmed.
The order is registered only after confirmation of the accuracy of the information provided. This acceptance of the order is made by clicking on the "Order" button.
We will acknowledge receipt of your order as soon as possible by sending an email detailing your purchases to the email address you provided when confirming the order.
When entering your order in our system, we will also inform you of the availability of the items ordered. If we cannot satisfy the whole order, we will let you know as soon as possible.
FLARONIS makes every effort to check the validity of the information posted online. However, we accept no responsibility for any errors or omissions. By law, we are committed to correcting all our errors promptly, without further compensation.
Only available products can be ordered, but if, beyond our control, an unavailable item was selected, an unavailability notice will be sent by email.

Sale of alcoholic beverages

By law, it is punishable for a person under the age of 18 to buy or attempt to buy alcohol. The seller therefore reserves the right to refuse to deliver certain persons or companies.

Price

The prices are indicated in euros (excluding VAT), excluding additional flat-rate contribution for the processing of the order (see the "Delivery" section below).
The VAT applied is that of the buyer's country on the date of the order.
The products remain the property of FLARONIS until full payment of the price.
FLARONIS reserves the right to refuse an order if a legitimate reason as defined by the rules (dispute relating to a previous order, unusual request from the customer).
Although the seller will do everything possible to ensure that the prices and delivery charges mentioned are correct, a price may not be set correctly. In this case, the seller will not be obliged to deliver this product at this incorrect price.
If the seller acts by providing the buyer with the necessary means of transport or by facilitating the customs formalities, he cannot in any case engage the responsibility of Flaronis. All resulting costs will be invoiced at the price indicated.
Any tax, present or future, of any nature whatsoever, is the buyer's responsibility.
Since 01/07/2001, in accordance with regional conventions relating to environmental policies when purchasing any new household or electronic appliance, a recycling tax has been collected on behalf of Recupel asbl, an approved body responsible for recovery and recycling of old devices, for an amount between 1 to 6 euros depending on the product. These costs are already included in the price.

Payment

For Eshop customers: Payment is made online, at the time of ordering, by credit card or via PayPal.

For B2B customers: payment is made by bank transfer under the following conditions:

"1 .- All invoices are payable on the due date. Any delay in payment automatically and without notice entails a commitment on the part of the customer to pay contractual interest of 12% per year on the amounts due.

"2 .- In the event of non-payment of invoices on the date of payment and without it being necessary to prevent it, in addition to the interest mentioned above, the amount of the invoice or the balance due will be increased 15% with a minimum of 50,00 €, as conventional compensation for non-payment of the invoice by the deadline.

"3 .- In the event of an unpaid invoice on the date of payment, all other unmatured invoices lose the benefit of the time limit and are due immediately and without notice.

"4 .- The delivered goods remain our property until full payment. The delivery of the goods involves the transfer of risk to the customer. The customer assumes from delivery the care of the products sold and is responsible for the damage caused by them. In the event of return of goods, the loss of value suffered will be deducted from the payments made by the customer.

"5 .- Any complaint relating to an invoice must be presented in writing, on pain of inadmissibility, within eight days of sending the invoice.

"6 .- The Court of EUPEN is the sole competent court for any dispute between the client and us, regardless of the place where the contract was contracted or performed. However, FLARONIS may assign the domicile of its client to the Court. .

All credit card transactions are made through secure online payment by PAYPAL.

For orders made on the Flaronis site, deliveries are made to the address indicated on the order form that you entered on our site.

Your order will not arrive more than 7 days after your payment period, taking into account the delivery and processing of your order. Our items are usually dispatched within 24-48 hours.

Any delay or failure of the expected benefit in the performance of this contract does not constitute an error attributable to the company FLARONIS, insofar as it can be proved that the delay is due to a "divine fact" as defined. by regulation.

You must carefully check the contents of the package on your arrival and in case of damage or missing items, do not forget to send us a precise and detailed return on the delivery note. Otherwise, you have a legal period of three (3) days, except public holidays, after receipt of the package to leave this return by registered mail with acknowledgment of receipt directly to the delivery company.
Packing and insurance:
Your purchases are packaged with the utmost care, using protective materials. The care we take in packaging allows us to offer delivery under the best conditions. The shipped goods are insured against theft and damage during the transport period. You must therefore ensure the integrity of your order and all the items making up the order upon receipt of the package and in the presence of the person making the delivery to make a remark if necessary.
If you have any doubts about the condition or content of the order, you must refuse the goods upon receipt of the package. Any refused item must be returned to the delivery person as a whole and in its original packaging.
In case of absence during the delivery, a delivery notice is left in your mailbox.

Withdrawal period

All returns must be made within five days of the package arrival date. Items must be returned by registered mail.
In these circumstances, the refund order will be made as soon as possible.
The product must be in its original packaging and accompanied by the accompanying documents during our shipment.

Guarantees and customer service

Most of our items sold benefit from the legal guarantee of conformity, the legal guarantee against hidden defects and the manufacturer's guarantee, the scope and duration of which differ between products and brands.
In the case of an exchanged order, the shipping costs of the item (s) are the responsibility of the customer. However, if the guarantee of conformity is applicable to the returned product, all costs related to this return will be reimbursed to the customer.
Whatever the problem with your product, you must attach a copy of the invoice, a copy of the warranty document and the return form to the defective item.
Please note, the warranty does not apply to damage resulting from a cause external to the device (accident, shock, lightning, fluctuation in the power supply, replacement of consumables such as batteries, bulbs, fuses, etc.) . Or the negligence of a customer caused by use not in accordance with the manufacturer's specifications, misuse for the good conservation of the device, use for commercial or collective purposes, use of inappropriate accessories or consumables , etc.
In this regard, we invite you to carefully examine the instruction sheet supplied with the products.
If any products do not conform to the information provided by the product presentation on the website or have hidden defects, they will be replaced or refunded depending on the availability of similar products and the customer's wishes. Items covered by the guarantee will only be taken back if they are accompanied by the delivery slip.
Also excluded from the warranty: products modified, repaired, built or added by the customer or any other person not authorized by the supplier.
The warranty will not work for visible defects and product defects for which any complaint must be made by the customer within 7 days of delivery of the products, under penalty of forfeiture. The warranty does not cover damaged products resulting from improper use.
In any case, Flaronis cannot be held responsible for the refusal of a manufacturer to impose its warranty for the reasons set out above.
All returns must be previously authorized by Flaronis with the sending of a return number. The customer must make the request by contacting info@flaronis.be after written acceptance by Flaronis.

Responsibility

Flaronis has only one obligation of means for all stages of access to the site, process control, delivery or after-sales service.
Flaronis cannot be held liable for any inconvenience or damage resulting from the use of the Internet, including an interruption of service, an external intrusion or the presence of computer viruses or any act characterized by a "case of force majeure", in accordance with case law.
Flaronis cannot be held responsible for damage of any nature whatsoever, bodily or material damage, which may result from a malfunction or from the improper use of the products sold. The same goes for any change resulting from product suppliers.
The responsibility of Flaronis, in all cases, will be limited to the amount of the order and cannot be blamed for simple errors or omissions that may occur despite all the precautions taken in the presentation of the products.
Flaronis will not be held liable to any customer or third party for any indirect damage, loss of business, profit or income, resulting in any way.
Without limiting the preceding paragraphs, the liability of Flaronis under these conditions does not exceed an amount equal to the amounts paid or payable during the transaction which gave rise to this liability, regardless of the cause or type of action. concerning.
Flaronis cannot be held responsible in the event of breach of contract in the event of out of stock or unavailability, "force majeure", disruption or total or partial strike of postal services and means of transport and / or communication, flood, fire.
Flaronis undertakes not to disclose to third parties the information provided by customers on the site. These are confidential. It will only be used by our internal departments for the processing of your order and to personalize and improve communication, including letters / emails and information, as part of the personalization of the website according to user preferences. . The Flaronis website may provide aggregated statistics on customers, sales, trading structures and related information on the site to reputable third parties, but these statistics will not include any personal data.
Flaronis does not sell or rent customer information to third parties.

Term

These general conditions apply throughout the duration of the online services offered by Flaronis.

Law and jurisdiction

These general conditions and the related contractual relations are governed by Belgian law. The language of this contract is French.
Any dispute will be brought before the EUPEN courts.
